About these terms

These terms govern your use of chrisjackson.website and any services provided by Chris Jackson, a Strategic Design Leader and Design Futurist based in Wellington, New Zealand.

By using this website or engaging my services, you agree to these terms. Please read them carefully. If you do not agree, please do not use this website or engage my services.

References to "I", "me", or "my" refer to Chris Jackson. References to "you" refer to the person or organisation using this website or engaging my services.

Use of this website

You may use this website for lawful purposes only. You agree not to:

  • Use this website in any way that violates applicable law or regulation

  • Reproduce, distribute, or commercially exploit any content from this website without my prior written permission

  • Attempt to gain unauthorised access to any part of this website or its underlying systems

  • Transmit any harmful, offensive, or disruptive content via this website

I reserve the right to update, modify, or remove content from this website at any time without notice.

You may download and use free resources provided on this website (such as the Futures of Design 2045 Scenarios and the Design Team Health Check) for personal and professional use. You may not reproduce, resell, or redistribute these resources without my prior written permission.

Services

Engagements

When you engage me for a service — including the Design Team Reset, futures thinking workshops, or coaching — the specific terms of that engagement will be agreed in writing before work begins. Those written terms, including scope, deliverables, timelines, and payment, take precedence over these general terms where there is any conflict.

Discovery calls

Discovery calls are offered at no charge and without obligation. Participation in a discovery call does not constitute a contract or commitment to proceed with an engagement.

Free resources

Free resources such as the Futures of Design 2045 Scenarios and the Design Team Health Check are provided as-is, for informational purposes. They are not a substitute for professional advice tailored to your specific situation.

Payment

Payment terms for engagements are agreed in writing at the outset of each project. Unless otherwise agreed:

  • Invoices are payable within 14 days of the invoice date

  • Payments are made in New Zealand Dollars (NZD)

  • Late payments may incur interest at the rate of 5% per annum above the Reserve Bank of New Zealand's Official Cash Rate

International clients are responsible for any bank transfer fees, currency conversion costs, or applicable taxes in their jurisdiction.

Cancellation and refunds

Engagements

Cancellation terms are agreed in writing at the outset of each engagement. Generally:

  • Work completed prior to cancellation will be invoiced at the agreed rate

  • Where a deposit has been paid, the portion attributable to work completed will be retained

  • Where an engagement is cancelled due to my inability to deliver, I will refund any fees paid for work not yet completed

Workshops

Workshop bookings cancelled more than 14 days before the scheduled date will receive a full refund. Cancellations within 14 days of the workshop date may be subject to a cancellation fee of up to 50% of the booking fee, at my discretion.

Coaching

Coaching engagements operate on a month-by-month basis unless otherwise agreed. Either party may end the engagement with reasonable notice. Fees for sessions already delivered are non-refundable.

Limitation of liability

I provide professional services with reasonable skill and care. However, I do not guarantee specific outcomes from any engagement, workshop, or coaching programme.

To the extent permitted by New Zealand law, my total liability to you for any loss or damage arising from my services is limited to the fees paid by you for the specific service giving rise to the claim.

I am not liable for any indirect, consequential, or incidental loss, including lost profits or lost business opportunity, even if I have been advised of the possibility of such loss.

Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Consumer guarantees

If you are a consumer under the New Zealand Consumer Guarantees Act 1993, nothing in these terms limits the rights and remedies available to you under that Act. Note that the Consumer Guarantees Act does not apply where services are acquired for business purposes.

Confidentiality

I treat all information shared with me during an engagement as confidential. I will not disclose client information to third parties without your consent, except where required by law.

Where I reference client work publicly (for example, as a case study), I will do so only in anonymised form unless you have given explicit permission to use identifying details.

Intellectual property in deliverables

Unless otherwise agreed in writing, the intellectual property in any deliverables I create for you — including frameworks, strategies, roadmaps, and reports — is owned by me until full payment has been received, at which point it transfers to you for the purposes agreed in the engagement scope.

I retain the right to use general methodologies, frameworks, and approaches developed in the course of our work together in future engagements with other clients.

Governing law

These terms are governed by the laws of New Zealand. Any dispute arising from these terms or my services that cannot be resolved directly will be referred to mediation in the first instance. If mediation is unsuccessful, disputes will be resolved by arbitration under the Arbitration Act 1996 (New Zealand), with one independent arbitrator based in New Zealand.

Changes to these terms

I may update these terms from time to time. The date at the top of this page indicates when they were last revised. Continued use of this website or engagement of my services after changes are posted constitutes acceptance of the updated terms.
